Matt Fontana Comments on Court Block of FTC’s Noncompete Ban Proposal With Axios
In the Axios article, “Fight over health noncompete pacts far from over,” labor and employment partner Matt Fontana commented on how the future of legislation restricting noncompetes may shape out across individual states instead of federally.
A federal court blocked the Federal Trade Commission’s (FTC) noncompete ban on August 20, 2024. Axios reported that the commission will seek to appeal the decision and that, regardless of if the federal ban goes into effect, several states, including New York, Pennsylvania and Louisiana are expected to begin to limit or ban noncompetes in the health care industry later this year.
Fontana noted that the FTC "managed to bring this issue to the fore" by showing how the arrangements affected about 1 in 5 U.S. workers, or around 30 million people.
