Overview

Jessica Natali is a white collar defense attorney and former Assistant U.S. Attorney for the Eastern District of Pennsylvania. She has deep experience both prosecuting and defending a wide range of criminal cases, particularly involving the health care, securities and financial services industries. Jessica represents entities and individuals in complex white collar defense matters, federal and state criminal cases, and grand jury investigations. She also frequently conducts internal and parallel investigations, while her civil practice often involves select product liability cases and the defense of qui tam and False Claims Act complaints. Additionally, Jessica assists clients in building and implementing policies and procedures consistent with the elements of an effective program under the Department of Justice (DOJ) and other government regulatory guidelines.

Fraud & White Collar Defense

Jessica represents entities and individuals from a broad array of industries — including medical device and pharmaceutical manufacturers, health care providers, pharmacies, banks, private equity firms, and financial service companies — in criminal investigations as well as in antitrust, securities and U.S. sanctions matters.

Her experience encompasses health care fraud, financial services fraud, wire and mail fraud, securities fraud, money laundering, public corruption, bankruptcy fraud, immigration fraud, sexual misconduct allegations, and election and campaign fraud, as well as violations of the Stark Law, Anti-Kickback Statute, False Claims Act, Health Insurance Portability and Accountability Act (HIPAA), Foreign Corrupt Practices Act (FCPA) and national security cases involving the International Emergency Economic Powers Act (IEEPA). She also handles international investigations.

Jessica has advised and worked closely with a variety of federal and local law enforcement agencies, including the Federal Bureau of Investigation, Drug Enforcement Administration, and U.S. Department of Health and Human Services, as well as offices of attorneys general, police departments and district attorney’s offices.

Strategy, Risk, Compliance & Internal Investigations

Jessica counsel clients on litigation strategy and risk mitigation, and negotiates settlements, nonprosecution agreements, deferred prosecution agreements and corporate integrity agreements (CIAs). She advises clients on compliance program development consistent with DOJ guidelines and assists with implementation, including drafting and revising policies, procedures, and related training regarding ethics and compliance and code of conduct violations, anticorruption, conflicts of interest, antitrust, and workplace health and safety issues. Jessica routinely conducts investigations on behalf of all forms of entities, including boards of directors, and board and audit committees, as well as for closely held companies and nonprofit organizations.

With a focus on health care and life science companies, Jessica leads and manages internal investigation teams, including leading interviews of key personnel, drafting fact-finding reports, and reporting results and related remediation and compliance improvements to operational leaders, management and boards of directors. Similarly, she advises on responding to internal ethics-hotline complaints. 

Health Care, Product Liability & Commercial Litigation

Jessica also represents medical device manufacturers and hospital systems in product liability litigation, professional negligence cases, and complex commercial litigation in state and federal court. She also has experience overseeing complex third-party subpoenas for large international corporations.

  • Representation of a large medical device company in a False Claims Act investigation and parallel criminal investigation conducted by DOJ involving misbranded products in violation of the Food, Drug and Cosmetic Act (FDCA).
  • Representation of key employees of a pharmaceutical company in a False Claims Act investigation conducted by DOJ.
  • Investigation and defense of the CEO of a Pennsylvania bank in a DOJ and Office of the Comptroller of the Currency (OCC) regulatory matter focused on a former senior trust officer who mismanaged funds.
  • Representation of a health care entity in both a False Claims Act investigation and a parallel grand jury investigation conducted by the Pennsylvania Office of the Attorney General and DOJ involving money laundering and health care fraud.
  • Representation of an executive in a securities fraud investigation conducted by the Securities and Exchange Commission (SEC) and DOJ.
  • Representation of a national medical laboratory in connection with a False Claims Act investigation and a parallel criminal investigation conducted by DOJ.

  • Representation of an individual in a national security and securities fraud investigation conducted by DOJ and the SEC.
  • Investigation and defense of a Pennsylvania state representative in a grand jury matter and prosecution by the Pennsylvania Office of the Attorney General.
  • Internal investigation and defense of a skilled-nursing facility.
  • Representation of a large medical device manufacturer in multidistrict litigation including overseeing a Pennsylvania team in more than 100 remanded federal cases.

U.S. Department of Justice Experience

Jessica served as an Assistant U.S. Attorney for the Eastern District of Pennsylvania’s criminal division for over 11 years and handled federal criminal cases including health care, mail, wire, mortgage and tax fraud matters, as well as a variety of violent crime matters. Her decorated career with DOJ includes successfully prosecuting more than 100 cases.
