Indiana University Files Amicus Brief in Favor of Same Sex Marriage

Our firm represented Indiana University (IU) in an amicus brief submitted to the United States Supreme Court in Obergefell v. Hodges. In that brief, IU argued that although same-sex marriage was currently lawful in Indiana due to a recent 7th Circuit ruling, Indiana had a statutory ban against same-sex marriage. The University explained that marriage inequality impedes Indiana University’s educational mission and its ability to attract and retain talented students, faculty, and staff. The University argued that state laws banning same-sex marriage violated the Equal Protection Clause of the Fourteenth Amendment. Indiana University was the only college or university to file an amicus brief in the Obergefell case.
