Senior Counsel Janet Fries spoke about the Supreme Court ruling in Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith et al. Janet detailed the implications of the court holding that the “purpose and character” of Warhol’s use of Goldsmith’s photograph did not fall within the affirmative defense of fair use and was instead an unauthorized derivative work for which a license should have been obtained.
