Construction and real estate litigation associate Ehren Fournier, with assistance from associates Kevin Major and Charles Rodriguez, authored an article for Building Knowledge, the newsletter of the Illinois State Bar Association’s Section on Construction Law, titled “Construction Whack-a-Mole: Termination for Cause, Termination for Convenience, and Actions for Breach of Contract.”
In the article, Fournier gives a hypothetical situation concerning subcontractor termination under Illinois public construction law. The author provides information and examples regarding contract damages, termination for convenience versus termination for default clauses, and changing rationales.
