Overview

Andrew Joseph is a Fellow of the American College of Trial Lawyers, who serves on the firm’s executive leadership team and is a member of the business litigation group and the class actions team. For decades Andrew has assumed first-chair responsibility for challenging business disputes for clients in their most significant litigation matters. A former prosecutor, Andrew has tried many cases to verdict. His practice is focused on consumer-facing disputes, class action litigation, complex commercial disputes and corporate investigations. As a seasoned litigator, Andrew takes a practical approach to determine the best course for each case, in light of the critical legal and business considerations, together with the client’s overall objectives. This approach allows clients to make informed decisions about whether a case is a candidate for a quick resolution, will require limited or more expansive discovery, or if it needs to be litigated and potentially tried. Andrew also counsels clients on minimizing litigation risk through strategic decision-making and best practices.

Class Action Litigation

Fortune 100 companies engage Andrew to defend class action suits brought in state and federal courts throughout the country. Andrew regularly serves as lead counsel defending class actions and has been the principal architect of defense strategies in matters litigated throughout the nation. Andrew has obtained favorable results on a host of class action claims involving allegations of fraud, invasion of privacy, breach of contract, misrepresentation, false advertising, unfair business practices, product defects, and other civil and statutory claims.

Consumer Fraud and Deceptive Practices Litigation

Andrew regularly defends clients in cases alleging violations of consumer fraud, unfair business practices, deceptive trade practices, false advertising and consumer protection statutes. He has represented clients in private actions involving such claims as well as in investigations and claims brought by state attorneys general and federal regulatory authorities. Andrew is skilled at formulating strategies to limit expansive and oppressive discovery in such matters and to successfully defend these claims on the merits.  

Business Litigation

Andrew defends corporations and executives in federal, state, arbitral and regulatory matters including claims of unfair business practices, consumer fraud, invasion of privacy, franchise disputes, professional malpractice, RICO, defamation, and commercial leasing and real estate disputes. As first chair counsel, Andrew has obtained favorable results in cases venued in jurisdictions throughout the country.

Corporate Investigations

Andrew has represented corporations, their officers and employees in civil, criminal and regulatory investigations before federal and state grand juries and in defense of criminal matters in the federal and state trial courts. Andrew has led sensitive and complex internal investigations involving public, private and nonprofit entities in the pharmaceutical, communications, financial services, manufacturing and environmental industries. He counsels clients on subpoena compliance, regulatory inquiries and other compliance issues.

Prosecutorial Experience

Before entering private practice, Andrew worked as a senior assistant district attorney in the Kings County District Attorney's Office in Brooklyn, New York. During his career there, Andrew was responsible for numerous high-profile prosecutions and was recognized for his accomplishments as a prosecutor.
