Faegre & Benson Wins Preliminary Injunction Appeal in Patent Case for Shock Doctor Inc.

The U.S. Court of Appeals for the Federal Circuit upheld a preliminary injunction obtained by Shock Doctor Inc. against competitor XO Athletic Company.

Shock Doctor moved for a preliminary injunction to prevent XO Athletic from entering the market with a protective mouthguard that infringes a Shock Doctor mouthguard patent. Faegre & Benson LLP represented Shock Doctor in the motion for preliminary injunction and in its successful defense of the XO Athletic appeal.

The appeal team included John Crimmins, Kevin Wagner, Shawn Gordon and Bill Roberts.
