Jesse Witten Quoted in Report on Medicare Compliance July 2012

Washington, D.C., partner Jesse Witten was quoted in the Report on Medicare Compliance regarding a False Claims Act settlement between his client, Overlook Hospital, and the United States Department of Justice (DOJ).

In a case instigated by two former employees-turned-whistleblowers, the DOJ alleged that from January 2002 – July 2009, Overlook charged Medicare for inpatient services that should have been provided on an outpatient basis.

Jesse, a partner in the Commercial Litigation Practice Group, said Overlook did not admit liability in the settlement: “We deny anyone got unnecessary care,” he said. “Whether they met inpatient criteria or should have been done outpatient is a judgment call.”
