Anticipating the Impact of the Executive Order on the U.S. Bulk-Power System: Roundtable Discussion

Recently, the Trump Administration revealed more about the “greater bilateral friction” between the United States and China involving trade, national defense and global economic policy. On May 20, 2020, the White House published a report in accordance with the FY2019 National Defense Authorization Act, United States Strategic Approach to the People’s Republic of China, detailing a whole-of-government strategy with respect to China. The report states that the U.S. will adopt a new “competitive approach” to the PRC — one that will protect U.S. vital national interests.

The Administration’s vow to take a more forceful stance against China is evident in the Executive Order (EO), “Securing the United States Bulk-Power System,” issued on May 1, 2020. The EO directs the Secretary of Energy to prevent “foreign adversaries” from exploiting vulnerabilities in the U.S. bulk-power system in support of U.S. national security. While the EO does not name specific countries, it is expected that China will be one of the countries thus identified. This latest EO follows a pattern established by President Trump’s EO on telecommunications technology and services, which was likewise issued under the authority of the International Emergency Economic Powers Act (IEEPA) and is also aimed at perceived threats to U.S. national security from China and Chinese government industrial policies.
