Unenforceable? A Legal Deep Dive Into Association Codes of Ethics & Conduct

Faegre Drinker partner Marilee Springer and associate Carrie Garber Siegrist led an in-depth discussion of the legal aspects and enforceability of associations’ codes of ethics and conduct with the American Society of Association Executives (ASAE) during the ASAE 2020 Annual (Virtual) Meeting.

Springer and Garber Siegrist covered the governance mechanisms available to membership nonprofit organizations to encourage member engagement, evaluated the scope of codes of conduct/ethics for optimized effectiveness with considerations for enforceability, helped participants develop an understanding of the minimum due process requirements when creating a procedure to enforce a code of conduct/ethics, and reviewed sample codes of conduct and ethics from similarly situated associations.
