2021 ERISA Litigation: What You Need to Know

ERISA litigation continues to be an ever-evolving area of law, and this past year was no different. With another case before the Supreme Court, numerous federal court decisions on 401(k) class actions and Department of Labor (DOL) guidance on cybersecurity, there was a lot to follow.
Members of Faegre Drinker’s ERISA litigation team discussed the most significant issues and trends in ERISA litigation from the past year. Specifically, our team addressed:
- The Supreme Court’s review of 401(k) excessive fee litigation in Hughes v. Northwestern
- 401(k)/403(b) class action updates
- Mandatory arbitration and class action waiver provisions in defined contribution plans
- Cybersecurity issues, including the DOL’s recent guidance for plan sponsors, service providers and plan participants
- Updates on union-related benefits litigation, including that involving multiemployer plans and retiree medical benefits
