What Amgen v. Sanofi Means for Patent Application and Litigation Strategy

On September 29, 2023, Tim Grimsrud and Lauren Barta presented a session at the Midwest IP Institute titled “The Enablement Requirement – What Amgen v. Sanofi Means for Patent Application and Litigation Strategy." Tim and Lauren addressed several foundational Federal Circuit decisions relating to the enablement of genus/species claims with functional requirements that laid the groundwork for the Supreme Court's 2023 Amgen v. Sanofi decision. They further discussed the impact of the Supreme Court's Amgen v. Sanofi decision on patent litigation and prosecution strategy.
