Overview

In the 2023-24 term, the Supreme Court has once again issued several landmark decisions that will affect the workplace and every American.

Among the most significant cases are:

  • Muldrow v. the City of St. Louis, in which the Court redefined the harm that plaintiffs must prove in order to make a Title VII claim.
  • Starbucks Corp. v. McKinney, in which the Court reversed the lower courts and imposed a more demanding standard when the NLRB seeks a preliminary injunction against an employer.
  • Murray v. UBS Securities LLC, which sets forth what a Sarbanes Oxley whistleblower must prove when bringing a retaliation claim. 
  • Loper Bright Enterprises v. Raimondo, in which the Court struck down the Chevron doctrine and the deference given to federal agencies.
