San Francisco partner Cheryl Orr will speak at the American Conference Institute’s 13th National Forum on Wage & Hour Claims and Class Actions on September 20 in San Francisco.
Invited panelists include leading in-house counsel, members of the judiciary and leading practitioners in the wage and hour class action arena.
Cheryl, co-chair of the firm’s Labor and Employment Practice Group, will co-present “Employee Misclassification: Defending Against the New Wave of Independent Contractor Misclassification Claims and Ensuring Proper Exempt or Non-Exempt Classifications.”
The presentation will address: what constitutes an independent contractor, including affected industries and statutory definitions; joint employment exemption concerns, i.e., who is in control and the theory of vertical integration; and determining exemption status for executive, administrative, professional and pharmaceutical outside sales employees under the FLSA.
