Florham Park associates Bill Wright and Brianna Kostecka co-presented “How to Navigate the Issues Involving Litigation Holds and Related E-Discovery Concerns,” a webinar sponsored by the New Jersey Institute for Continuing Legal Education (NJICLE).

The webinar included practical tips for drafting and issuing litigation holds and for handling issues relating to discovery of electronically stored information, as well as examined recent and seminal case law.

Bill and Brianna also discussed the overlap between the work product doctrine’s “in anticipation of litigation” standard and the requirement that a litigation hold be implemented when a party “reasonably anticipates” litigation. The webinar then focused on what to do with electronically stored evidence once it is preserved and will evaluate certain e-discovery issues, including appropriate collection formats, proportionality and cost concerns.
