FTC v. Actavis: Inviting a More Nimble Rule of Reason

Washington, D.C. partner Ken Vorrasi and counsel Bob Skitol co-authored “FTC v. Actavis: Inviting a More Nimble Rule of Reason,” for the American Bar Association’s Antitrust magazine. The article examines the Supreme Court’s Ruling in FTC v. Actavis, in particular the resolution of the prior conflict among the circuit courts regarding the applicable standard for “reverse payment” or “pay for delay” patent settlements within the pharmaceutical industry. Ken and Bob also consider what the decisions might mean for antitrust litigation going forward.
