Drinker Biddle Lawyers Co-Author Article on Manufacturer Representative Liability and Discovery in Pharmaceutical and Medical Device Mass Tort Actions.
Michael C. Zogby, partner and co-chair of the Products Liability and Mass Tort Group and the Pharma and Life Sciences Group, and associate Abigail Luhn collaborated with Porter Ledges LLP partner Joseph Cohen on an article discussing how manufacturers’ sales representatives—otherwise known as detail representatives—are increasingly named in product liability lawsuits. “So, You’re Just a Sales Rep?—Manufacturer Representative Liability and Discovery in Mass Torts,” discusses issues relating to fraudulent joinder, liability issues, duty of care, distinctions between pharmaceutical and medical device representatives, discovery, and preservation. The article was published by DRI and distributed in connection with its May 16-17 Drug and Medical Device Seminar, at which Mike spoke on the same topics.
