Product liability and mass tort partners Joseph Winebrenner, Michael Zogby and Jessica Brennan authored chapters in the American Bar Association’s “Mass Torts in the United States.” Winebrenner co-authored chapters titled “Setting the Stage,” “Theories of Liability” and “Defenses,” and Zogby and Brennan co-authored the chapter titled “Role of Science and Expert Evidence,” with Christine Lozier of Novo Nordisk.
The book provides a history of mass tort litigation, followed by chapters that discuss various stages of individual cases, including preliminary considerations such as jurisdiction and venue. The book also provides insight on theories of liability and defenses and mechanisms courts use to manage mass tort cases, including class actions and multidistrict litigation (MDL).
Chapters also address discovery, experts and settlement in the context of mass torts, and explore unique issues that arise in mass tort litigation.
