Scott Kosnoff Speaks With Legaltech News About Proposed Artificial Intelligence Regulations

In an article titled “As the US Grapples With Regulating AI, EU’s Approach Looms Overhead,” Legaltech News spoke to artificial intelligence and algorithmic decision-making (AI-X) team co-leader Scott Kosnoff about the future of United States artificial intelligence (AI) regulations following recently proposed regulations in the European Union (EU) and Canada.

Kosnoff noted that as the U.S. has been paying attention to algorithmic decision making, impact assessments are already finding their way into federal and state legislative proposals. “As people become more and more aware of the significant role that AI and algorithmic decision-making plays in our daily lives, it becomes more and more of a concern for regulators in some states, and they’re sort of grappling with how best to address it.”

Kosnoff does not see federal legislation from Congress happening in the near future and said he believes this is leaving a vacuum to be filled by federal agencies and courts.

Regarding the effectiveness of impact assessments as a way to regulate AI, Kosnoff stated, “Impact assessment has often been sort of part of the discussion, but it certainly hasn’t been a constant or like the be-all and end-all. I think it would be safer to say that there has been a sort of extensive concern expressed by federal and some state regulators about the potential for bias against protected classes.”
