Emma Vennesson Comments on Non-Disclosure Agreements With Law360

In “Lawyers Fear Crackdown on NDAs Could Harm Employees,” Law360 turned to labor and employment counsel Emma Vennesson for her commentary on non-disclosure agreements in the workplace.

“It has given rise generally, I would say, to a more balanced way of looking at the settlement agreement,” said Vennesson, who noted that employers should consider the potential risk to their reputation of asking an employee to agree to confidentiality.

“The employer is going to have to think about the true value of the NDA, whether they’re ever going to enforce it and whether it’s a dealbreaker,” Vennesson added.
