EU Directive Implementation Facilitates Class Action Shift

Product liability and mass torts partners Teresa Griffin and Patrick Reilly, and associate Eldin Hasic coauthored an article for Law360 titled “EU Directive Implementation Facilitates Class Action Shift” – the first in a series of articles covering the European Union’s Collective Redress Directive, which had a full implementation deadline of June 25, 2023.
Griffin, Reilly and Hasic provide an overview of the directive, its purpose, and filing trends observed in the lead up to implementation. Specifically, the authors discuss the increase in filings of class and consumer actions leading to this point, as well as those aspects of the directive that will result in a pro-claimant landscape that is friendly to representative actions and will transform litigation culture across the EU over time.
In subsequent articles, the authors will share key developments as the directive is further implemented across the EU and will partner with practitioners from EU member states to discuss directive implementation, trends and experiences in their respective jurisdictions.
