Mary Will Comments on 2024 Labor and Employment Legislation in Colorado With Law360

In “Colorado Legislation To Watch In 2024,” Mary Will, deputy general counsel and labor and employment partner, spoke to Law360 about changes to labor and employment legislation in Colorado that become effective in 2024.

First, the publication reported on how employers will be prohibited from asking about a prospective employee’s age, date of birth, and dates of school attendance or graduation in an initial job application under the Job Application Fairness Act starting on July 1. Will said employers and interviewers should pay attention to the nuances of these requirements.

When people ask questions, “as long as it’s not ‘how old are you,’ they’re not necessarily thinking about it,” Will explained, noting certain questions about a candidate’s background could indirectly reveal their age. “This will require interviewers and recruiters to be a lot more sensitive and cautious and require some training internally.”

Law360 further addressed Senate Bill 23-046, which determines the benefit based on earnings during a “base period.” Will urged companies not to overlook a requirement that employers notify an applicant they can redact age-identifying information before sharing materials like professional certifications and school transcripts.
