In “Why IP Attys Are Watching This $2B Trade Secrets Battle,” business litigation partner Randy Kahnke spoke to Law360 about the potential impact of a case involving two software companies on trade secret litigation across the United States, including what constitutes trade secrets and reasonable measures to protect them.

“It’s a $2 billion award. That’s eye-popping, and people are looking at it,” said Kahnke. “The more we become used to seeing large damages awards in trade secret cases, the more it becomes a viable alternative means of protecting intellectual property.”

“We’ll want to see what happens here,” Kahnke added, referencing the dispute. “Does the trend continue? Is this another reduction, or does this one stand?”
