A Midwest food company successfully defended against a petition for injunctive relief by the National Labor Relations Board (NLRB). Our firm's labor management relations team represented the food company in the dispute.
The NLRB claimed the company interfered with, restrained and coerced their employees, failed to bargain collectively in good faith with the Union, and impermissibly implemented its best and final offer after labor negotiations stalled. The NLRB asked the U.S. District Court for the Northern District of Iowa for an injunction against the company during the pendency of proceedings before the NLRB seeking, among other things, an order revoking implementation of the company’s best and final offer.
In July 2016, following an evidentiary hearing, our firm secured an order denying in full the NLRB’s request for injunctive relief.
