Session Four (Friday, August 27, 2021) – The First Amendment and Food Marketing Litigation: Restoring the Legal Balance

Over the last decade, there has been a flood of consumer deception claims against food manufacturers, with most focusing on the product labels. But there has been little recognition by the courts that these lawsuits are government regulations of speech that are subject to the First Amendment. The First Amendment ordinarily makes it easy to speak and hard for the government to punish or suppress speech. But deceptive practices laws, in contrast, make it hard for food manufacturers to speak on the labels of their products and easy for that speech to be punished through lawsuits seeking damages. This is a profound disconnect, and we’ll discuss how the balance of the law can be restored.
