The jury pool and juror profiles are important to assessing legal and factual arguments, but lawyers should be mindful to avoid stereotypes. Jury consultants and focus groups are good resources for theme testing and witness preparation. And how your case will resonate with potential jurors is central to mediation strategy. The panel of a retired commercial court judge and two litigators discussed these issues with lessons learned from cases they’ve handled through settlement and trial.
