Alice M. Morical

Overview

Alice Morical is a go-to trial court and appellate litigator, who is skilled at effectively navigating complex and high-stakes litigation. She represents business clients in commercial litigation, non-compete and trade secret litigation, and product liability disputes, as well as professional service providers in significant state administrative proceedings.

Alice enjoys learning about her clients’ businesses and priorities and offering practical advice and creative solutions to help them navigate the legal system to achieve their business objectives. She finds that developing an effective strategy, preparing thoroughly and maintaining an objective perspective are key to maximizing her clients’ chances for success.  

She is an elected member of the American Law Institute, a senior fellow of the Litigation Counsel of America, and a distinguished life fellow of the Indianapolis Bar Foundation. Business Litigation & Appeals

In federal and state courts, Alice represents companies and individuals in disputes relating to breach of contract claims, mergers and acquisitions, business torts, securities fraud, and defamation claims. In addition to experience with jury and bench trials, Alice has also represented clients in arbitrations and on appeal in federal and state appellate courts.

Business Litigation & Appeals Representative Experience

  • Obtained a favorable jury verdict for a publicly traded company sued for breach of contract and fraud in connection with the sale of a subsidiary. Asserted a successful indemnification counterclaim relating to defense of the breach of contract claim.
  • Represented a publicly traded company in a successful Seventh Circuit appeal to overturn an adverse jury verdict in a defamation case involving a matter of public concern.
  • Represented a publicly traded company in a declaratory judgment action to defeat Indiana statutory claims and achieve early dismissal of the case. 
  • Represented a municipality in successfully overturning a trial court summary judgment order and then obtaining summary judgment for the municipality. 
  • Represented majority shareholders in defending an injunction brought by a minority shareholder.
  • Defended the managing members of an LLC in a dispute with current and former minority members against claims including freeze-out, breach of the operating agreement, and breach of fiduciary duty.
  • Represented a supplier of goods in a contract dispute in a federal diversity suit.

Non-compete & Trade Secret Litigation

Alice counsels both companies and executives in interpreting, enforcing and challenging non-compete agreements and claims of trade secret misappropriation. 

Non-compete & Trade Secret Representative Experience

  • Represented a corporation and its president in the pursuit of damages against former officers alleged to have engaged in wrongful competition with the corporation.
  • Represented an executive in arbitration involving the enforceability of a non-compete agreement involving national accounting firms.
  • Represented founders and their newly formed company sued for unfair competition after their departure from a national firm. 

Professional Licensing

Alice represents physicians, accountants and other professional service providers as well as their firms in licensure matters. She has represented clients before Indiana’s Medical Licensing Board, Funeral & Cemetery Board, and Board of Accountancy.

Professional Licensing Representative Experience

  • Represented a doctor in a high-profile Medical Licensing Board proceeding and successfully defeated an attempt to restrict the doctor’s medical license. 
  • Represented accounting and funeral services companies and their employees in licensure matters.

Professional & Community Service

Alice believes that nonprofit service and pro bono work are important to the health and vitality of both the legal profession and her community of Indianapolis. She has served the Indianapolis Bar Association in a number of capacities and as a director for various organizations, including Elements Financial, a federally charted credit union originally formed to serve employees of Eli Lilly. Alice also enjoys mentoring early-career attorneys to help them develop into strong advocates for our clients.

Personal Interests

Alice and her husband are grateful they share interests with their adult children, who all love traveling, reading, eating out and just spending time together. She travels frequently to the East and West Coasts to visit them. Alice also enjoys running half marathons, hiking in Brown County and in any travel destination, cooking New York Times recipes, getting together with friends, and attending cultural events.
