Mental Health Part 2: Accommodations, Remote Work Management & Performance Management Issues
2025 Labor & Employment Law Developments: Staying on Top of Your Game
Webinar
Overview
As employers continue to navigate mental health, it’s essential to understand the evolving legal and practical challenges of managing accommodations, remote work, and job performance while fostering a supportive workplace culture. In the second session of our two-part series on mental health, Nicole Truso and Angela Johnson will provide actionable insights and guidance on how to effectively navigate these areas while facilitating compliance with employment laws.
Topics Include:
- Mental Health Accommodations: How to assess and implement reasonable accommodations for employees with mental health conditions that are in compliance with the Americans with Disabilities Act and its state counterparts (including requests for full or partial remote work based on mental health conditions), managing intermittent or continuous leaves of absence under federal and state leave laws (e.g., the Family Medical Leave and state and local paid sick and safe leave laws).
- Legal Compliance: Best practices for employers to enable the meeting of their legal obligations while supporting employee mental health needs, maintaining workplace safety, and addressing confidentiality and documentation requirements.
- Remote Work Management: Addressing the unique challenges of managing remote employees with mental health needs, including maintaining a supportive work environment and fostering engagement, as well as strategies for supporting employees who return to on-site work.
- Performance Management: Balancing employee performance expectations with mental health considerations, including performance evaluations, goal setting, and handling performance issues in a way that supports employee well-being while meeting organizational objectives.
- Workplace Culture: Creating an inclusive workplace culture that prioritizes mental health, avoids stigma or stereotyping, and supports employees at all levels.
