Sarah Brew Weighs in on New FDA Powers in an Interview with Law360

In January 2011, the U.S. Food and Drug Administration was granted the power to revoke a company's food facility registration under the Food Safety Modernization Act. For the first time, the FDA suspended a food producer's registration when it recently shut down Sunland Inc. The agency's citation of Sunland's poor safety record, including a salmonella outbreak that has sickened more than 41 people, suggests that it will reserve issuing citations for repeat offenders, not isolated recalls.

Sarah Brew, told Law360 that this should help reassure companies concerned by the agency's new powers. "For your average food company, it should not be a cause for serious alarm. This doesn't mean the FDA's going to come in on routine inspections and start suspending companies' registration," Brew said. She added that, "This really demonstrates that a recall isn't enough if the FDA doesn't have confidence the company has implemented rigorous preventative controls to prevent something like this from happening in the future."
