Larry Del Rossi and Dan Prokott Speak to SHRM About State Non-Compete Agreements
The Society for Human Resource Management (SHRM) turned to labor and employment partners Larry Del Rossi and Dan Prokott for insight as a growing number of states, including New York and Minnesota, will potentially ban or have banned non-compete agreements.
According to the publication, the New York Legislature passed a bill that would ban non-compete agreements. The legislation’s “scope is very broad, and its details are very little,” said Del Rossi. He noted that HR professionals should stay up to date on state laws involving non-compete agreements and have accurate records of where their employees work.
The trend of banning non-competes is likely to spread to more states in the near future, Prokott stated. He explained that the state laws do not clearly define what a business competitor is, which can make things confusing for employers that use non-competes. Further, Prokott said that non-compete agreements have particularly high use in the health care, financial services and IT industries.
