Overview
Matt Elliott’s practice centers around his lifelong commitment to advocacy. Matt combines his litigation experience with his government background to advance the needs of clients in and outside of state and federal courts, before government agencies, and during regulatory investigations and administrative proceedings. He also regularly represents clients in litigation matters arising from business disputes and class actions, where he applies practical solutions and a team-oriented approach to clients' most challenging issues.
State Attorneys General & Regulatory Litigation
Matt represents clients in investigations, administrative proceedings and litigation related to enforcement and regulatory actions by state attorneys general and government agencies. Matt’s experience also includes investigations and proceedings involving consumer protection regulators; state departments of insurance; state gaming, alcohol and tobacco regulators; Medicaid audit disputes; and related federal agencies. From consumer protection complaints to multistate investigations, Matt leverages his prior government experience to resolve disputes efficiently and effectively with regulators. Additionally, Matt regularly counsels clients across several industries — ranging from retail and consumer goods to life sciences companies — related to state credit card surcharge laws and compliance.
Class Action Defense
Matt defends consumer class actions in state and federal courts throughout the country. Through all stages of class action litigation, he advocates for clients’ interests through strategic use of discovery and depositions, dispositive motions, challenges to class certification, settlement negotiations, and trial preparation. His experience includes defending putative class actions involving homeowners and commercial property insurance, health insurance, automotive defect claims and allegations of environmental contamination.
Commercial & Insurance Litigation
For clients ranging from multinational public corporations to individuals owning closely held companies, Matt’s commercial litigation experience in state and federal courts includes matters involving breach of contract claims, disputes concerning business ownership and control, trade secrets, and allegations of consumer fraud and deceptive trade practices. Matt also represents insurers in high-stakes litigation matters, including class actions, large-scale first-party claims and regulatory disputes involving property and casualty, long-term care, life insurance and annuities.
Government Experience
Before joining the firm, Matt served as a deputy attorney general at the Office of the Indiana Attorney General, where he represented the state in civil litigation and appeals in both state and federal courts. While working with Indiana’s Solicitor General, Matt’s caseload ranged from arguing cases in state trial courts to drafting appellate briefs in the U.S. Supreme Court. This included drafting critical motions, briefs and amici curiae briefs led by Indiana and joined by dozens of other state attorneys general. Additionally, he advised agencies and officials on a variety of legal matters, including related to administrative and constitutional law, and helped lead multistate consumer protection investigations and litigation.
Matt’s experience is also informed by his background in public policy and communication strategy having previously worked for the Governor of Indiana and the Indiana House of Representatives prior to law school. Matt also served as a judicial extern for the Honorable Mark S. Massa of the Indiana Supreme Court.
