Overview

Joshua Waldbeser counsels retirement plan sponsors, investment advisors, asset managers and funds, and other financial services providers on their fiduciary responsibilities under ERISA, and keeps them on course with regulatory compliance matters. Formerly with the Department of Labor (DOL) Employee Benefits Security Administration, Joshua has an insider’s view of the regulatory challenges faced by employers with respect to their own plans, and by insurance companies, registered investment advisers, broker-dealers, recordkeepers, banks and trust companies with respect to their services to plans and IRAs. He provides practical, business-oriented advice that reflects the interplay between ERISA, tax, and other sources of law, and focuses on compliance and risk mitigation.

Employee Benefits

Joshua advises on compliance with all aspects of ERISA, and on design and operational considerations for 401(k) and other defined contribution plans, as well as cash balance and traditional defined benefit plans. He provides advice on retirement plan investments, tax qualification and other compliance matters, including DOL and IRS regulations, fiduciary duties and best practices, and prohibited transactions and exemptions.

Plan fiduciaries, investment advisers and asset managers turn to Joshua for counsel on the legal, regulatory and tax dimensions of alternative investments for ERISA plans.

Investigations and Audits

Joshua represents plan sponsors, plan committees and fiduciaries, and financial services providers before the Internal Revenue Service and the DOL with respect to investigations and audits of retirement plan operations and investments, as well as IRS and DOL correction programs.

Tax-Exempt Institutions

Joshua counsels tax-exempt and governmental employers with respect to 403(b) and 457 plans, including issues specific to governmental, hospital and church plans. He also advises on fiduciary and investment governance matters for pension plans and non-plan institutional asset pools such as foundations and endowment funds, including the review and negotiation of private capital and other investments.

Representative Experience

  • Assisted a large tax-exempt health care system with establishing a unitized series trust investment platform across a wide variety of asset classes, to allow its operating units and foundations to populate their own asset allocations across the series funds on an aggregated, cost effective basis
