Customs and International Trade Team Takes Big First Step in Anti-Dumping and Anti-Subsidy Case

A recent article on Law360 highlighted the major first step in a case that involves Drinker Biddle attorneys Doug Heffner and Richard Ferrin, and Senior International Trade Analyst Rick Johnson, who represent Auburn Manufacturing Inc. (AMI), a textile company that is the leading supplier amorphous silica fabric (ASF) to the U.S. Navy.

The company filed a pair of petitions with the U.S. Department of Commerce and U.S. International Trade Commission claiming that imports of certain ASF, originating from China, have ravaged its business interests because they were dumped and unfairly subsidized.

In its dumping petition, AMI alleged that “Chinese ASF is being sold at unfairly low prices in the U.S. market and requested anti-dumping duties of more than 160 percent to offset the damage from those imports.” According to the article, “the case will likely be accepted by the commerce in the next few days and the agency will hear arguments from both sides before deciding on appropriate level of countervailing duty rates.”
