Delaware and Corporate Law

Delaware has long been known as a center for corporate and commercial law because it is the state of incorporation for the majority of the Fortune 500 and most publicly traded companies. The Delaware Court of Chancery issues nationally significant corporate and alternative business entity law decisions concerning challenges to actions by boards of directors, claims of breach of fiduciary duty, merger and acquisition litigation, and all other aspects of corporate governance. Because Delaware is the domicile of so many of the nation’s business entities, Delaware's Superior Court and the federal district court are popular for multiparty commercial disputes. In the last 10 years some of the most significant patent and trademark decisions and jury verdicts have come from Delaware's federal court. The National Law Journal has referred to the District Court in Delaware as the "preeminent patent court in the United States." Delaware also is a preferred forum for national bankruptcy filings and litigation.

Patent Litigation

The District of Delaware has been a popular venue for patent litigation for over a century, but following the landmark decision in TC Heartland, more patent litigation continues to shift into the First State. In recent years, Faegre Drinker’s team of Delaware-based IP litigators has responded to the uptick in cases by handling an extensive range and volume of patent litigation and infringement and patent prosecution cases for corporate clients.

Community Involvement

Throughout the year, the Wilmington office raises funds for and contributes time to helping nonprofit organizations in the community. These nonprofits benefit those who are impoverished or coping with serious illness.

Delaware Combined Campaign for Justice 

The Wilmington office contributes to the Delaware Combined Campaign for Justice, which raises money for Delaware Community Legal Aid Society, Inc. (CLASI), Delaware Volunteer Legal Services (DVLS) and the Legal Services Corporation of Delaware (LSCD). These important organizations help ensure that people in need receive critical legal assistance.
