Overview

As the times change, so do the inquiries and benefits litigation claims that an employer or plan administrator is likely to face. Join Faegre Baker Daniels as we discuss recent trends to be aware of and how to handle claims procedures and litigation strategies.

Between the retirement of about 10,000 baby boomers each day and the ever-increasing significance of benefits as a component of employee compensation, employers are receiving an endless stream of requests about benefits. We will guide attendees through the maze of issues that relate to these requests, including document retention, the administration of benefit claims and appeals, the new disability claims procedures, and the fiduciary exception to attorney-client privilege.

In addition, plaintiff lawyers and in-house counsel are constantly testing new strategies for demanding benefit plan payments. We will cover the general principles of benefits litigation and discuss new issues that are arising in specific contexts, including life insurance claims, out-of-network medical provider claims, and discovery issues in claims-related benefit cases.

This program is being submitted for Indiana Continuing Legal Education (CLE) certification. The program will also be submitted to the HR Certification Institute (HRCI) and Society for Human Resource Management (SHRM) for continuing education credit review.
