Advanced Patent Law & Litigation: Developments in the Enablement Defense

On October 6, 2021, Faegre Drinker Partners Lauren Barta, David Gross, Timothy Grimsrud and Associate Bethany Mihalik held a seminar with Minnesota CLE titled “Advanced Patent Law and Litigation: Developments in the Enablement Defense.” The group examined how the Federal Circuit has heightened the standards for both the Enablement and Written Description requirements. They discussed leading cases, including Amgen and Juno Therapeutics, and explored how these defenses are used in genus/species claims, function claim limitations, and other types of claims.
