Design Around Patents to Avoid Liability, Reduce Risk: Andrew McCoy in Ethanol Producer Magazine

Andrew McCoy of Faegre Baker Daniels authored an article in Ethanol Producer Magazine outlining how ethanol producers can avoid patent infringement lawsuits stemming from their processing methods and products. McCoy explained that producers can design around a patents in a way that will avoid infringement altogether, or alleviate risks of enhanced damages award if it is determined that a product does indeed infringe a patent.

McCoy added that designing around a patent is just one of several options available for reducing the risk of patent infringement. Ensuring that your IP counsel understands your product is also key to a successful design-around.
