Trip DeMuth in the Denver Post on the Science, or Lack Thereof, of Jury Selection
Jurors are being chosen for the trial of James Holmes, the man who killed 12 people and injured 70 in a mass-shooting in a Colorado movie theater in July 2012. FaegreBD partner Trip DeMuth, who previously worked at the Boulder County district attorney's office, was interviewed by the Denver Post on the criteria lawyers use to select jurors in a high profile case.
DeMuth told the Denver Post that lawyers consider many factors when thinning the jury pool like their line of work or television shows and movies they watch. "It's a very unscientific process," DeMuth said.
He noted that prosecutors may shy away from engineers and scientists because they tend to be more analytical and will often have higher standards for proof. "Every lawyer has different views on what may or may not make a good juror," DeMuth said. "It becomes a very individual type of analysis."
