A number of putative class actions have been filed in California in recent years related to the capture of personally identifiable information (PII) as part of in-store credit card transactions. These cases, brought under the state’s Song-Beverly Credit Card Act, follow a California Supreme Court decision holding that ZIP codes constitute PII. This article provides background on the Act and examines how retailers can develop policies that will help protect against such suits.
