Can Businesses Limit Exposure to Product Liability Claims Related to COVID-19?
Product liability and mass torts associates Blake Angelino and Bryan Pasciak coauthored an article for the American Bar Association’s Mass Torts Newsletter titled, “Product Liability Claims We Expect to See as a Result of COVID-19.”
In the article, Angelino and Pasciak discuss how companies should not overlook how the steps they take to adapt to the new normal could impact exposure to product liability claims related to COVID-19. The article outlines proactive steps businesses can take to limit exposure to costly litigation, including understanding the potential claims plaintiffs may bring and knowing the new laws that can offer tort immunity. Two of the laws the authors highlight are the Public Readiness and Emergency Preparedness (PREP) Act and the Coronavirus Aid, Relief, and Economic Security (CARES) Act, which the government intended to limit the liability of companies helping to fight the COVID-19 crisis.
