The American Lawyer Speaks to Scott Kosnoff and Bennett Borden About Launching the Firm’s AI-X Team
Artificial intelligence and algorithmic decision-making (AI-X) team co-leaders Bennett Borden and Scott Kosnoff spoke with The American Lawyer about launching the interdisciplinary AI-X team, artificial intelligence (AI) law and regulations, and how automated decision-making is changing the day-to-day work of lawyers.
In the Q&A article “As Regulators Step Up, Faegre Drinker Doubles Down on AI,” Borden and Kosnoff discussed how, over the last several years, regulators have begun to express concern about the use of automated decision-making and AI in places that touch regulated interest and how attorneys across the firm’s practice groups have been getting involved in the space.
“We decided there was enough going on across these industries that we should pool our talent to address them in a uniform way and share the learning from our experience,” said Borden.
Kosnoff addressed what the litigation component of the group is. “For all the great benefits that using artificial intelligence and algorithmic decision-making can bring to organizations, there’s certainly a litigation risk as well. We have litigators following these issues closely and are poised to help out should one of our clients land in court,” he explained.
Borden highlighted the data analytics capabilities of the group, including the firm’s wholly owned data analytics subsidiary Tritura. “We are very heavily involved in actually helping companies evaluate their algorithms and testing them for unintended bias and looking at governments’ frameworks to make sure compliance is built in and monitoring is built in,” he shared.
