NBC10 Philadelphia Turns to Barry Gross for Insight on Issuing of Federal Search Warrants

NBC10 Philadelphia reported that the Federal Bureau of Investigation executed a search warrant at Mar-a-Lago in Florida, seeking official documents that former President Trump allegedly took from the White House. White collar criminal defense senior counsel Barry Gross addressed the requirements for this type of search warrant.

Barry outlined the three things that had to be proven to a federal judge: “That you have probable cause to believe that a crime has been committed or is being committed, that the items that you’re searching for — in this case, it appears to be official documents — are evidence of that crime and that you have probable cause to believe that these documents are at that location.”

“This says to me that there’s a real concern here about the integrity of these documents,” Barry added. He further discussed considerations for searching the property of a current or former public official and noted the importance of politicians ensuring information is correct.

In a separate news segment, NBC10 Philadelphia also turned to Barry for insight on Doug Mastriano, Pennsylvania governor candidate, refusing to testify before the Jan. 6 Select Committee.
