Respect for Marriage Act Renews Estate Planning Opportunities for Same Sex Couples

Private client partner Lisa Presser and associate Brian Balduzzi coauthored an article for New Jersey Law Journal on how the Respect for Marriage Act impacts married same-sex couples in their estate planning, while identifying opportunities for families and advisors.

Presser and Balduzzi provide an overview of the Respect for Marriage Act, which repealed the 1996 Defense of Marriage Act. The authors also discuss New Jersey’s and other states’ and federal recognition of same-sex marriage, estate planning and probate, incapacity planning and inheritance tax.
