Erica MacDonald Addresses Georgia’s RICO Act With WCCO

In a segment for News Talk 830 WCCO, business litigation partner Erica MacDonald discussed the details of the latest indictment of former President Donald Trump.

MacDonald said, “It is a large speaking indictment…The scope of what’s alleged here is very fulsome and inclusive.” She added, “What stands out to me the most is this is the first time we have seen Georgia’s Racketeer Influenced and Corrupt Organizations (RICO) Act used in this context.”

Regarding RICO, MacDonald stated, “It’s not a tool that’s just limited to the mafia or to organized crime; it’s anything where there’s a criminal enterprise alleged to be involved, a conspiracy if you will, that then took alleged acts to complete the object of that conspiracy.” She noted, “A criminal enterprise is simply meaning that it’s a group of individuals who came together with a concerted effort and purpose of bringing about an illegal act — in this case, the allegation is the illegal act was to illegally undo the results of the 2020 election.”
