Overview
Diego Garcia is a commercial litigator and legal strategist. His practice focuses on defending clients in complex cases and class actions, including consumer fraud, ADA public accommodation discrimination and commercial contract claims. His clients include large-scale landlords and property management companies.
Diego has taken and defended depositions of key fact and expert witnesses; successfully briefed and argued dismissals in various federal courts; secured injunctive relief to protect clients; and obtained favorable outcomes in discovery disputes before state and federal courts.
Class Action Defense
Throughout his tenure at the firm, Diego has supported clients in defending and managing class actions. This experience includes:
- Working with clients to develop case themes and litigation strategies that fit their needs
- Conducting meet-and-confer conferences, and managing complex and rigorous discovery including its strategy and posture
- Coordinating contact with expert witnesses and preparation of expert reports
- Deposing key witnesses and defending key depositions, including expert witnesses
- Briefing various motions including dismissals, oppositions to class certification, dispositive motions, discovery issues and motions related to experts•
- Leading large teams of attorneys and support staff in the day-to-day operations of class action litigation
Consumer Fraud
Diego has advocated for clients in consumer fraud litigation in state and federal courts around the country, from which he well understands the nuances of these types of claims. This experience includes:
- Successfully briefing and securing dismissal of consumer fraud claims
- Obtaining certification of novel consumer fraud questions to a state supreme court
- Managing and assisting consumer-perception experts with their analyses and reports
- Assisting in taking and defending depositions of consumer-perception experts
- Briefing procedural and dispositive motions, including summary judgment
Public Accommodation Discrimination
Diego defends clients facing allegations of disability discrimination under the Americans with Disabilities Act and similar state laws. He has a track record of favorable outcomes in this focused area of law.
Prior Experience
During law school, Diego was a judicial extern for Chief Judge D. Brooks Smith of the U.S. Court of Appeals for the Third Circuit. He was a summer associate at Faegre Drinker for two summers, working closely with the business litigation, class action and bankruptcy teams. This work included drafting a motion to dismiss with nine causes of action filed in state court, writing multiple interrogatories and requests for production, and researching for and advising a partner about shared defense privilege for confidential information.
Prior to law school, Diego worked as a ranch hand near Bozeman, Montana, and he brings to bear the same ethic and attitude of hard work for clients.

Outside the office, Diego enjoys spending time outdoors with his family and golfing.
