Overview

Ever Hess counsels clients in high-stakes matters existing at all procedural postures, ranging from pre-litigation and case inception through post-trial and appeal. She has represented clients in matters concerning a variety of complex claims, including those involving commercial contracts, constitutional law, state torts, Title VII, the Lanham Act, and federal preemption, as well as precedent-setting Copyright Act and Digital Millennium Copyright Act claims. She has extensive experience drafting successful dispositive motion briefs and other briefs for clients, has argued motions in federal district court that have resulted in successful outcomes for clients, and has helped secure other meaningful outcomes for clients ranging from preliminary injunctions and favorable settlements to significant post-trial wins.

Ever also has considerable appellate experience. She has assisted in drafting a petition for certiorari to the United States Supreme Court and has helped obtain wins for clients in the appellate courts. Before joining the firm, Ever was an assistant attorney general at the Maryland Office of the Attorney General, where she independently drafted dozens of successful appellate briefs on behalf of the State and presented numerous appellate arguments resulting in significant wins for the State.

After law school, Ever clerked for the Hon. Kathryn Grill Graeff of the Appellate Court of Maryland. Ever began her practice with Faegre Drinker, then worked as an associate at a litigation boutique that specialized in copyright and trademark law and at the Maryland Attorney General’s Office before rejoining the firm.

Personal Interests

Ever is a horse enthusiast who has received several national and regional titles on the Arabian Horse Association’s equestrian competition circuit. She is also a self-proclaimed foodie and enjoys indulging in D.C.’s wonderful restaurant scene.
