Overview

For more than 20 years, Bill Horwitz has taken up the mantle for employers navigating wage-and-hour class and collective actions as well as claims of whistleblowing, breach of contract, retaliation, sexual harassment, and disability and race discrimination. He is a steadfast resource on enduring and emerging issues in employment law and a steely advocate for employers in litigation before state and federal courts, before administrative agencies and in arbitration. As a former prosecutor for the Queens County (NY) District Attorney’s Office, Bill leverages his experience to anticipate and outmaneuver opposing arguments.

As a member of the firm's pay equity team, Bill routinely works with clients on conducting pay equity audits. He also advises and represents clients in disputes arising from data privacy, trade secrets and related violations.

Labor and Employment Counsel

Bill advises management on employment-related issues and workplace dispute prevention. He counsels clients in connection with reductions in force and drafts employment contracts, arbitration agreements, separation agreements and employment handbooks. When wage-and-hour audits are required, Bill evaluates the data and advises clients with respect to the classification of workers as independent contractors or as exempt or nonexempt employees. Bill also conducts audits of employment policies and practices. In the health care arena, Bill advises employers regarding their compliance obligations under New Jersey’s Health Care Professional Responsibility and Reporting Enhancement Act (Cullen Law).

Employers also retain Bill to conduct investigations of alleged workplace misconduct. He has been tapped by Fortune 100 corporations, nonprofit organizations and others to conduct such inquiries.

Employment Litigation

Bill is valued by clients for his dogged defense in a variety of industries, including health care, commercial real estate, life sciences, finance, hospitality and retail. He has helped dismantle a nationwide putative collective action with 160-plus members, defeat a motion for the conditional certification of a 625-strong collective action and obtain summary judgment dismissals in numerous cases.

Privacy, Trade Secrets and Unfair Competition

Bill represents clients in disputes involving misappropriation of trade secrets and unfair competition and has litigated these claims in various states, including temporary restraining order and preliminary injunction hearings. In addition, Bill works with companies to implement and enhance policies, procedures and agreements to safeguard confidential information and business relationships.
