Overview

With experience ranging from startups to global corporations in an array of industries, Brittany Kaplan protects and promotes clients’ brands worldwide. In supporting clients’ global portfolios of intellectual property, Brittany particularly focuses on trademark clearance, prosecution, protection, enforcement and portfolio management. With individualized strategic guidance, she helps clients navigate the lifecycle of trademarks from selection and clearance to filing and registration, and finally to maintenance and enforcement in a variety of industries.

Trademarks & Copyrights

Beyond domestic and international trademark prosecution, Brittany handles trademark disputes at the Trademark Trial and Appeal Board (TTAB). She is equipped to advance clients’ interests through dispute management strategies including negotiating assignment, coexistence, consent, license and settlement agreements related to intellectual property.

Brittany counsels clients who face cybersquatting and online infringement issues including domain name disputes pursuant to the Uniform Domain-Name Dispute-Resolution Policy, and website and social media takedowns involving the Digital Millennium Copyright Act.

Brittany also assists clients with copyright protection and enforcement.

Advertising & Media

Brittany assists clients with marketing and advertising matters related to consumer promotions including sweepstakes, contests and influencer campaigns.

IP Transactions

In addition, Brittany represents clients on IP matters related to business transactions, such as mergers and acquisitions.

Prior Experience

After a decade in the magazine publishing industry, Brittany enrolled in law school to pursue her law-related passions and merge them with her media background to provide clients insightful counsel on trademarks, copyrights, advertising and marketing.

Personal Interests

In her free time, Brittany enjoys reading, crossword puzzles and yoga, and frequents Orangetheory Fitness.
