Overview
An employee benefits lawyer, Maureen Maly helps employers. insurers and service providers design cost-effective health and welfare programs, while minimizing legal risks and administrative complications. She develops an understanding of the client's history, structure and strategy — and strives to exceed expectations of high-quality, practical, efficient and responsive employee benefits counsel.
Guiding Clients on Health Plan Compliance
Maureen helps employers and administrators make sense of the myriad of health plan compliance and administrative issues, with a particular focus on self-funded plans, including:
- Advising on reporting and disclosure obligations, compliance obligations and potential penalties, including advising on essential health benefits, actuarial value and other insurance market reforms
- Determining how ACA's "pay or play" penalties may affect an employer’s workforce
- Evaluating options for joining a private exchange
- Revising or terminating existing retiree medical plans and deploying assets in overfunded VEBAs
- Advising on collective bargaining obligations and language to address ACA contingencies
- Advising on ACA compliance for nontraditional workforces
- She also regularly counsels clients on the evolving requirements related to wellness programs, consumer-driven health plan, transparency, and mental health parity, among others.
Privacy and Security Compliance
Maureen works to help clients stay compliant with HIPAA and other privacy and cybersecurity rules and to manage related issues, including:
- Advising insurance companies regarding privacy obligations for new coverage types, including critical illness, hospital indemnity and travel
- Assisting with privacy and security breach incidents
- Designing and implementing HIPAA training programs
- Negotiating business associate contracts
- Drafting detailed HIPAA privacy and security compliance policies and procedures
