Overview

Elizabeth McLachlan offers comprehensive legal counsel on insurance matters, including issues related to the secondary market for life insurance, stranger-originated life insurance (STOLI), premium financing and viatical settlements. Elizabeth advises and represents national life insurers in efforts to substantiate claims of material misrepresentations and void insurance policies ab initio. She also represents national insurance and annuity companies in disputes over the transfer of structured settlement payment rights, and has experience managing these matters in jurisdictions nationwide.
Outside of her insurance practice, Elizabeth serves as a key resource to the state government. She represents the Delaware Secretary of State in administering the State of Delaware’s Voluntary Disclosure Agreement (VDA) program. Established in 2012, the program focuses on bringing holders of unclaimed property into full compliance with the Delaware Abandoned Property Law for all past calendar years.
